1. Application of General Terms and Conditions of Sale
These General Terms and Conditions of Sale govern the contractual relationship between:

Any order placed on the site implies full and complete acceptance of these General Terms and Conditions of Sale. The customer declares that they have the necessary legal capacity to enter into a contract.
2. Products offered, descriptions, and availability
Products offered
Poké-Geek offers, in particular, trading cards, trading card games, sealed products, booster packs, displays, gift sets, accessories, board games, goodies and merchandise from the Pokémon, One Piece Card Game, Magic: The Gathering, Yu-Gi-Oh!, Disney Lorcana and other collectible universes.
Product information
Poké-Geek strives to present products with the greatest possible accuracy. Descriptions, titles, images, specifications, quantities, and technical information are based on data provided by publishers, manufacturers, distributors, or suppliers.
Images are provided for illustrative purposes only. Minor differences may exist between the image shown on the site and the product received, particularly regarding changes in packaging, supplier imagery, edition, language, version, branding, or presentation decided by the publisher or manufacturer.
In the event of a material error, obvious inaccuracy, or inconsistency in a product listing, the customer is advised to contact customer service before opening, using, or unsealing the product. Official information appearing on the product packaging, as provided by the publisher or manufacturer, shall prevail if it clearly identifies the nature of the product received.
If a description error is reported before the product is opened, Poké-Geek may offer—depending on the circumstances and in accordance with applicable statutory warranties—a correction, return, exchange, store credit, or refund.
Availability
- In-stock products: generally shipped within 24 to 48 business hours after payment confirmation, excluding peak periods.
- Pre-order products: shipped from the official release date, subject to Poké-Geek actually receiving the stock.
- In the event of stockouts or an inability to source the product, the customer will be notified as soon as possible.
3. Orders
Placing an order
The customer must provide accurate and complete information when placing an order, including their surname, first name, delivery address, email address, and telephone number. Poké-Geek shall not be held liable for any delay, return, or failure to deliver resulting from incorrect, incomplete, or outdated information provided by the customer.
Once payment is confirmed, an order confirmation email is sent to the customer at the email address provided during the purchase.
Right to refuse or cancel
Poké-Geek reserves the right to refuse or cancel any order in the event of an ongoing dispute, suspected fraud, attempted abuse, invalid address, abnormal order, manifest pricing error, abusive behavior, or serious difficulty regarding the fulfillment of the order.
In the event of cancellation initiated by Poké-Geek, the customer will be refunded the amounts paid, except in specific situations justifying a legally applicable deduction or covering costs already incurred in a context not subject to the statutory right of withdrawal.
4. Pre-orders
Certain products may be offered for pre-order. Pre-ordering allows the customer to reserve a product prior to its official release, subject to availability from publishers, manufacturers, distributors, or suppliers.
Any pre-order constitutes a firm commitment to purchase, subject to availability from the supplier, publisher, or distributor. The quantities received by Poké-Geek may be lower than the quantities initially announced or expected.
Release dates and timeframes
Release, arrival, and shipping dates indicated on the site are provided for information purposes only. They are subject to change by publishers, manufacturers, distributors, suppliers, or carriers. Poké-Geek shall not be held liable for delays resulting from schedule changes, stock allocation limits, supplier delays, carrier delays, or any circumstances beyond its control.
Cancellation or inability to supply
In the event of a release cancellation by the publisher, a permanent inability to source the product, or insufficient stock allocation preventing the order from being fulfilled, Poké-Geek may offer the customer a refund, a store credit, or a substitute solution, depending on the situation. If a refund is required by the circumstances, it will be processed in accordance with applicable legal provisions.
Mixed orders
When an order contains both in-stock products and pre-order products, the entire order is shipped at once when all products become available, unless otherwise indicated during the ordering process or agreed upon with customer service.
If the customer wishes to have immediately available products shipped separately, additional shipping fees may be charged.
5. Prices and payment
Prices
Prices are quoted in euros (€), inclusive of all taxes where VAT applies, but excluding shipping costs. Shipping costs are displayed prior to final order confirmation.
The prices applied are those in effect at the time the order is confirmed. Poké-Geek reserves the right to modify its prices at any time; such changes will not affect orders that have already been confirmed, except in the case of a manifest pricing error.

The order is considered confirmed only after full payment has been received. In the event of a refused, incomplete, disputed, or cancelled payment, Poké-Geek reserves the right to suspend or cancel the order.
Customs duties and taxes outside the European Union
For any shipment outside the European Union or to French Overseas Departments and Territories (DOM-TOM), customs duties, local taxes, import fees, or administrative charges may apply. These costs are the sole responsibility of the customer and are not the responsibility of Poké-Geek.

Delivery times are estimates and may vary based on the season, carrier, delivery location, public holidays, peak periods, or any event beyond Poké-Geek's control.
Order processing
Orders are generally prepared and shipped within 24 to 48 business hours after payment confirmation, excluding pre-orders, peak periods, inventory checks, out-of-stock situations, or special cases.
A tracking number is sent via email once the carrier has collected the parcel.
On-site order pickup
On-site pickup is only possible when this option is explicitly offered during checkout. Pickup can only take place after the customer receives an email confirming that their order is ready.
Pickup is by appointment only, during the hours specified by Poké-Geek. Arriving on-site without prior confirmation of availability or an appointment does not guarantee that the order can be handed over.
The order must be collected by the person who placed it, upon presentation of a valid ID matching the name on the order. If a valid form of identification is not presented, Poké-Geek reserves the right to refuse handover of the order.
Collection of the order constitutes effective delivery of the products to the customer. The customer is advised to check the apparent condition of the order at the time of collection and to immediately report any visible issues before leaving the premises.
Incorrect address, refused or unclaimed parcel
In the event that a parcel is refused, unclaimed, returned due to an incorrect or incomplete address, not collected from a pickup point, or cannot be delivered due to information provided by the customer, a refund may be issued once the parcel has actually been returned to Poké-Geek.
In such cases—and barring the valid exercise of the statutory right of withdrawal—Poké-Geek may deduct costs actually incurred, including outbound shipping costs, carrier return fees, preparation costs, logistics processing fees, and payment fees not refunded by payment service providers.
No refund may be claimed until the parcel has been received and inspected by Poké-Geek.
7. Right of withdrawal and returns
Statutory withdrawal period
In accordance with the provisions of the Consumer Code, the consumer customer has a period of 14 days from receipt of the order to exercise their right of withdrawal, without needing to provide a reason for their decision.
Where the order involves multiple products delivered separately, the period begins upon receipt of the final product.
Exercise procedure
To exercise the right of withdrawal, the customer must notify us of their decision clearly and unequivocally by email at info@poke-geek.fr or via the withdrawal tool provided on the website.
Where required by regulations, Poké-Geek provides a tool allowing the customer to submit their withdrawal request directly online.
Return conditions
The customer must return the products within 14 days of notifying us of their withdrawal. Products must be returned complete, clean, unused, properly protected, and in their original packaging.
Return costs are borne by the customer, unless the return is due to an error on the part of Poké-Geek or subject to an express commercial agreement with customer service.
Opened, unsealed or altered products
Products that have been opened, unsealed, used, or whose packaging has been altered are not accepted for return or exchange under our commercial policy. Mandatory statutory rights remain applicable.
This clause does not affect statutory warranties applicable in the event of a lack of conformity or a hidden defect.
Refund in the event of withdrawal
In the event of a valid exercise of the statutory right of withdrawal, Poké-Geek shall refund the customer in accordance with the provisions of the Consumer Code. The refund covers the legally due amounts, including standard delivery costs where applicable.
Additional costs resulting from the customer's choice of a delivery method more expensive than the standard delivery method offered are not refunded, unless otherwise required by law.
Poké-Geek may withhold the refund until the products have been recovered or until the customer has provided proof of shipment, whichever occurs first.
Commercial cancellation prior to shipment
Apart from the statutory right of withdrawal, any cancellation request made prior to shipment is reviewed on a case-by-case basis and may be accepted as a commercial gesture.
Where a cancellation is accepted as a gesture of goodwill and does not stem from a legal obligation to provide a full refund, Poké-Geek may deduct costs actually incurred, including transaction fees not refunded by payment service providers, as well as preparation or logistics costs already incurred.
Alternatively, depending on the circumstances, the customer may be offered a credit note for the full or partial amount of the order.
Discounted, sale, or clearance products
Discounted, sale, promotional, or clearance products are covered by the same statutory warranties as other products. The right of withdrawal remains applicable to distance purchases, subject to any applicable legal exceptions or depreciation in the value of the returned product.
8. Statutory warranties
Products sold by Poké-Geek are covered by applicable statutory warranties, specifically the statutory warranty of conformity and the warranty against hidden defects, under the conditions provided by law.
Statutory warranty of conformity
Consumer customers benefit from the statutory warranty of conformity when the product received does not correspond to the contract, description, quantity, quality, or expected characteristics, subject to applicable legal conditions.
Hidden defects
Customers may also benefit from the warranty against hidden defects when the product has a hidden defect that renders it unfit for its intended use or significantly impairs such use.
Limitations specific to collectible products
Collectible cards, sealed products, and TCG products may exhibit minor variations related to manufacturing, printing, cutting, centering, packaging, or the manufacturer's internal transport. Minor defects that do not affect normal use or the essential conformity of the product do not necessarily constitute a lack of conformity.
For sealed products, Poké-Geek cannot guarantee the random contents of booster packs, booster boxes, gift sets, or collectible products when such contents depend on the distribution determined by the publisher or manufacturer.
9. Claims, damaged packages, and customer service
Claims upon receipt
The customer is advised to check the condition of the parcel and products upon receipt. Any visible anomaly—such as a damaged parcel, damaged product, missing product, or apparent error—must be reported to customer service as soon as possible (within 48 hours), accompanied by photos of the parcel, packaging, carrier label, and the products concerned.
This reporting timeframe facilitates the processing of the claim with the carrier but does not deprive the customer of their statutory rights or warranties.
Products opened or used prior to reporting
In the event of an apparent issue with a sealed product, the customer is advised not to open, unseal, or use the product before contacting customer service. Opening or using the product before reporting the issue may limit the available solutions, particularly if the product's condition prevents its resale or inspection in its original state.
Fraud attempts or abuse
10. Liability
Poké-Geek shall not be held liable for non-performance or delay in the performance of an order in the event of force majeure, external events, strikes, supplier delays, carrier delays, supply shortages, insufficient publisher allocation, natural disasters, technical incidents, or any event reasonably beyond its control.
Poké-Geek shall not be held liable for indirect damages, commercial losses, operating losses, loss of opportunity, or non-material harm resulting from the purchase or use of the products, to the extent permitted by law.
For business customers, Poké-Geek’s liability is limited to the amount of the relevant order, except in cases of gross negligence, willful misconduct, or where otherwise provided by law.
11. Personal Data
Poké-Geek collects and processes the customer's personal data for the purposes of order management, payment, delivery, customer service, fraud prevention, and—where the customer consents—sending commercial communications.
In accordance with applicable personal data protection regulations, the customer has the right to access, rectify, object to, erase, and restrict the processing of their data.

12. Intellectual Property
All elements on the poke-geek.fr website—including texts, visuals, logos, graphic elements, structure, layout, and content—are protected by applicable intellectual property rights.
Any unauthorized reproduction, representation, adaptation, or use, whether in whole or in part, is prohibited.
Trademarks, licenses, product names, and visuals related to the Pokémon, One Piece Card Game, Magic: The Gathering, Yu-Gi-Oh!, Disney Lorcana, or other licensed universes belong to their respective owners.

14. Applicable law and dispute resolution
These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute, the competent courts shall be determined in accordance with applicable legal rules, particularly those protecting consumers.
For business customers, and subject to mandatory legal provisions to the contrary, any dispute relating to the formation, performance, or interpretation of these General Terms and Conditions of Sale may fall under the jurisdiction of the courts within the district of Poké-Geek's registered office.
