1. Purpose and scope

These Terms of Use govern access to poke-geek.fr, browsing the website and use of its online features and services.

The website is operated by Media Discount 77, a French single-member simplified joint-stock company with share capital of €1,000, registered with the Meaux Trade and Companies Register under number 834 277 857, whose registered office is at 1 Rue des Peupliers, 77177 Brou-sur-Chantereine, France, under the trading name Poke-Geek.

By accessing the website or using its features, the user accepts these Terms of Use. Purchases made on the website are governed separately by the General Terms and Conditions of Sale and the applicable commercial policies.

2. Access to the website

General access to the website is available to users with Internet access. Certain services may require the creation of an account, the provision of information or acceptance of additional terms.

The user is responsible for their equipment, connection and the costs associated with accessing the website.

3. Service availability and changes

They must promptly inform Poke-Geek at info@poke-geek.fr if they suspect unauthorised access, compromise of their means of authentication or fraudulent use.

The user must not create an account in the name of a third party without permission, impersonate another person or circumvent a suspension.

5. Permitted and prohibited uses

The website must be used fairly, lawfully and in accordance with its intended purpose.

In particular, it is prohibited to:

Trademarks, licences, product names, characters and visuals relating to Pokémon, One Piece Card Game, Magic: The Gathering, Yu-Gi-Oh!, Disney Lorcana, Dragon Ball and other universes shown on the website belong to their respective owners. Their presence on the website does not transfer any rights.

7. User content, reviews and contributions

Where the website allows a review, rating, image, comment or other content to be published, the user remains responsible for their contribution and represents that they have the rights necessary to publish it.

The user grants Poke-Geek a non-exclusive, royalty-free right to host, reproduce and display their contribution for the purposes of publishing and moderating it and operating the website, for as long as necessary for those purposes and within the limits permitted by law.

Poke-Geek may moderate or remove content that is manifestly unlawful, fraudulent, irrelevant, promotional, abusive, infringes a third party’s rights or breaches these Terms of Use. This ability does not constitute a general monitoring obligation.

The website may integrate or contain links to services operated by third parties, including payment, delivery, review, loyalty, wishlist, social media, authentication or analytics services.

Poke-Geek endeavours to keep the information on the website accurate and up to date. However, errors, omissions, temporary unavailability, packaging changes or variations originating from publishers, manufacturers, distributors or service providers may occur.

The terms applicable to a sale, including the product ordered, its price, availability and delivery, are specified in the product page, order summary and General Terms and Conditions of Sale.

10. Sales and applicable policies

Orders, payments, pre-orders, deliveries, collections, returns, refunds and warranties are governed by the General Terms and Conditions of Sale, Shipping Policy and Return and Refund Policy available on the website.

In the event of a conflict concerning a sale, the Customer’s mandatory statutory rights remain applicable.

Personal data is processed in accordance with the Privacy Policy and the privacy-choice management tools available on the website.

12. Suspension or closure of an account

Where circumstances allow, the user is informed of the measure and the reason for it. Suspending or closing an account does not extinguish rights and obligations attached to orders already concluded or applicable statutory warranties.

13. Liability

Poke-Geek is responsible for its obligations under the conditions provided by law. Nothing in these Terms of Use excludes or limits liability where it cannot legally be excluded or limited.

Poke-Geek is not liable for consequences exclusively attributable to the user’s equipment, connection, improper use of the website or an event constituting a lawful ground for exemption, subject to mandatory statutory provisions.

The user remains responsible for the consequences of their own content and any infringement of another person’s rights.

14. Changes to the Terms of Use

Poke-Geek may amend these Terms of Use to reflect legal, technical or functional developments. The applicable version is the one published on the website at the time of the relevant use. Amendments do not retroactively affect rights acquired under a contract already concluded.

15. Governing law and competent courts

These Terms of Use are governed by French law.

For consumer users, the competent courts are determined in accordance with the applicable statutory rules.
